This User Agreement (“Agreement”) governs your use of the BJURNY application and related services (together, the “Service”), operated by Home Ecosystems (“we”, “us”, “our”).
By creating an account, using the Service, or uploading any content, you agree to this Agreement. If you do not agree, do not use the Service.
Important summary: Public photos you upload must be yours (or you must have permission), and may be used by BJURNY and commercial partners. Private photos stay private and are not shared publicly or with partners.
1) Who can use BJURNY
You must be legally able to enter into this Agreement and comply with applicable laws. If you are under the legal age of majority where you live, you must have permission from a parent/guardian.
2) Your account
You are responsible for activity under your account and for keeping your login credentials secure. You must provide accurate information and keep it up to date.
3) User content: what you can upload
“User Content” means anything you upload or submit to BJURNY (including photos, notes, plant entries, and metadata).
- Plant photos only. BJURNY is for plants. Upload photos that primarily depict plants (e.g., whole plant, leaf, flower, habitat context).
- No illegal or harmful content. You may not upload content that is unlawful, abusive, hateful, sexually explicit, threatening, misleading, or that violates third-party rights.
- No personal data in photos. Avoid uploading photos containing sensitive personal information or clearly identifiable people.
4) You must have rights to upload
When you upload User Content (including photos), you confirm that you created it yourself or you have permission/license to use and upload it, and that doing so does not violate anyone else’s rights (including copyright, trademark, privacy, or publicity rights).
5) Public vs. private content
BJURNY supports different visibility modes for your content:
A) Public content
If you upload or mark content as public, you understand it may be visible to other users and may be used to improve BJURNY.
License for public content: You grant Home Ecosystems a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, modify (e.g., resize/crop/format), distribute, publicly display, and otherwise use your public User Content:
- to operate, improve, and promote BJURNY and our related services, and
- to share with commercial partners (e.g., nurseries, plant suppliers, marketplaces, and content partners) for legitimate uses connected to BJURNY (such as catalog listings, education, or product information), including commercial use.
We do not claim ownership of your content, but we need these rights to run BJURNY and enable partner features.
B) Private content
If you upload or mark content as private, we will treat it as private within BJURNY:
- We will not publish it publicly.
- We will not share it with commercial partners.
We still need limited rights to host and process private content only to provide the Service to you (e.g., store it, sync it, show it to you, back it up).
6) Analytics and usage data
To operate and improve BJURNY, we collect and analyze usage data (sometimes called “analytics”). This may include:
- how often users open and use the app (e.g., DAU/MAU, session counts),
- which screens and features are used (e.g., search, collections, editor),
- which plants users view in detail (clicks to plant detail pages),
- which provider links users click for a plant (outbound clicks to suppliers/partners),
- basic device/app information (e.g., platform, app version), and error/crash diagnostics.
We use this data to monitor performance, improve usability, prioritize features, and understand which plants/providers are most relevant. We do not sell your private photos. Private content remains private as described above.
7) Moderation, removal, and enforcement
We may review, remove, or restrict access to content that violates this Agreement or could harm users, partners, or the Service—without prior notice. You can delete content inside the app where the feature is available. Residual copies may remain temporarily in backups/logs for operational and security reasons.
8) Intellectual property
BJURNY, its design, code, trademarks, and branding are owned by Home Ecosystems and its licensors. You receive a limited, personal, non-transferable right to use the Service.
9) Disclaimer
BJURNY provides plant information and tools for convenience only. We do not guarantee completeness, accuracy, or specific outcomes for plant care. Use the Service at your own risk.
10) Limitation of liability
To the maximum extent permitted by law, Home Ecosystems is not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.
11) Termination
You may stop using BJURNY at any time. We may suspend or terminate your access if you violate this Agreement or if required for security or legal reasons.
12) Changes to this Agreement
We may update this Agreement occasionally. If changes are material, we will provide notice (e.g., in-app or via email). Continued use after updates means you accept the updated Agreement.
