Terms of service

These Terms of Service govern use of home-ecosystems.com and contracts made
directly with Home Ecosystems SrL for products and services. They also contain
general terms for the Home Ecosystems app and optional account-linked services.
Mandatory consumer rights and any terms presented by Apple App Store, Microsoft
Store or another authorised seller continue to apply where relevant.

2. Eligibility and acceptance
You must have legal capacity to enter the relevant contract. If you act for a
company or another person, you confirm that you are authorised to bind them.
By placing an order, accepting a quotation, creating an app account or using an
account-linked service, you agree to the terms presented for that activity.
Browsing the website does not itself oblige you to make a purchase.
3. Product information and availability
We aim to describe products, compatibility, prices and availability accurately.
Images may show styling, plants, enclosures, lights, sensors, actuators or other
items that are not included. The applicable product page and order confirmation
identify what is included.
Compatibility with a third-party sensor, actuator or platform applies only to
the exact models, generations, modes and firmware versions shown in the current
supported-device documentation. A reference to a brand does not mean that every
product from that brand is supported or that Home Ecosystems is endorsed by
that brand.
Products and features described as preview, beta, planned, “coming soon” or
subject to a release gate are not part of a purchase unless the order expressly
says otherwise.
4. Prices, taxes and orders
The checkout or accepted quotation shows the price, applicable taxes and
delivery charges known at that time. For cross-border delivery, import duties,
taxes or carrier charges may be payable by the recipient unless checkout
expressly states that they are included.
Submitting an order is an offer to buy. An automated acknowledgment confirms
receipt, not necessarily acceptance. A contract is formed when we send an order
acceptance or dispatch confirmation, or when we begin an agreed service.
We may reject or cancel an order before acceptance for a genuine reason,
including unavailability, an obvious price or description error, payment
failure, suspected fraud, export or delivery restrictions, or inability to
perform a custom project safely. If payment has been taken for a cancelled
order, it will be refunded.
5. Delivery, returns and legal guarantee
Delivery is governed by the Shipping Policy and order confirmation. Withdrawal,
returns, refunds and defective goods are governed by the Return and Refund
Policy.
Nothing in these Terms excludes the mandatory legal guarantee or other
non-waivable consumer rights.
6. PlantArt commissions and services
A PlantArt commission, custom ecosystem, installation or consulting engagement
requires a written quotation or project agreement. That document should define:
- scope, measurements, materials and items included;
- site access, electrical, water, structural and environmental requirements;
- design and customer approval stages;
- price, taxes, deposit and milestone payments;
- estimated schedule, delivery, installation and acceptance;
- maintenance responsibilities and living-material expectations; and
- cancellation or change consequences.
Natural and living materials vary and change over time. Unless specifically
agreed, visual references communicate a design direction rather than an exact
promise that plants, wood, stone or other natural materials will be identical.
Custom-made or clearly personalised goods may be exempt from the statutory
change-of-mind withdrawal right. Mandatory rights relating to conformity and
workmanship remain unaffected.
7. Safe installation and use
Follow the product label, setup guide, rated electrical limits, environmental
limits and safety instructions. Mains-voltage electrical work must be performed
only by a suitably qualified person where required.
Home Ecosystems products automate environmental equipment but are not medical,
fire-safety, life-support or other safety-critical systems. Do not use them as
the sole protection against fire, electric shock, flooding, overheating,
freezing, harm to people or animals, or loss of valuable property. Use
independent safeguards, correct electrical protection and reasonable
supervision appropriate to the risk.
You are responsible for the safe suitability of third-party equipment and for
testing each automation before unattended use. Remote status can be delayed or
unavailable; do not assume that absence of an alert proves that conditions are
safe.
8. Local control, accounts and cloud services
Supported controllers are designed to perform core automation locally. Internet,
cloud or app services do not replace correct local configuration.
Shopify customer accounts and Home Ecosystems app accounts are separate. You
are responsible for accurate information, authorised users and account
security.
Optional remote monitoring, remote control, history, analytics or alerts are
available only where the app version, controller capability, subscription,
account entitlement, controller permission and production service release all
allow them.
Service availability may be affected by Internet access, local network
configuration, external providers, maintenance, security incidents or force
majeure. We will use reasonable care in providing paid digital services and
will not remove mandatory remedies for a service that does not conform to the
contract.
9. Subscriptions
Available subscription plans, current prices, billing period, renewal terms and
included features are displayed before purchase. Monthly and annual products
may offer the same service level for different billing periods.
Subscriptions purchased in an app are processed by the applicable app store.
They renew automatically unless automatic renewal is cancelled through the
store account within the period stated by that store. Upgrades, downgrades,
renewal timing, taxes and refunds follow the applicable store rules and
mandatory law.
Cancelling renewal ordinarily leaves the entitlement active through the paid
period. Refunds, revocations, payment failure or expiry may end paid
entitlements earlier. When a paid entitlement ends, the controller should
continue supported local operation, but paid cloud features may be disabled
after a reasonable reconciliation period.
Deleting an app account does not automatically cancel billing managed by Apple
or Microsoft. Cancel the subscription in the relevant store before or when
deleting the account.
10. Software license
Subject to these Terms and the applicable store terms, Home Ecosystems grants
you a personal, limited, non-exclusive, non-transferable and revocable license
to use the proprietary Home Ecosystems app and proprietary service components
for their intended purpose.
You may not copy, sell, sublicense, bypass access controls, interfere with the
service, extract credentials, impersonate another controller or account, or
reverse engineer proprietary components except to the extent that applicable
law expressly permits this despite the restriction.
11. Open-source firmware
Home Ecosystems firmware source identified as open source is licensed under
Apache License 2.0, and third-party components may have their own licences. The
app and cloud services are not made open source merely because they interact
with open-source firmware.
The applicable open-source licence governs copying, modification and
distribution of that firmware. Apache-2.0 permits commercial use, modification
and redistribution subject to its conditions, including preservation of
required copyright, licence and notice information and its patent-related
terms. It does not grant rights to use Home Ecosystems trademarks or imply that
Home Ecosystems supports or certifies a modified build.
Third parties may build compatible controllers or modified firmware. Access to
Home Ecosystems account-linked services remains subject to service
compatibility, security, fair-use and subscription requirements that apply
equally to eligible hardware. A modified or third-party build must not
misrepresent itself as an official Home Ecosystems product.
12. Intellectual property and trademarks
Except for material expressly offered under an open-source or other third-party
licence, the website, app, designs, text, graphics, photographs, documentation,
service software and Home Ecosystems branding are owned by or licensed to Home
Ecosystems SrL.
No right to use the Home Ecosystems name, logo or other marks is granted except
to describe genuine compatibility accurately and lawfully.
13. Acceptable use and security
You must not:
- access another person's account, controller or data without authorisation;
- use copied credentials or controller identities;
- disrupt, overload, scan or probe the service without written authorisation;
- transmit malicious code or unlawful content;
- circumvent subscription, rate, safety or security controls; or
- use the service in a way that violates law or third-party rights.
Good-faith security reports should be sent to support@home-ecosystems.com and
must avoid privacy violations, service disruption and access beyond what is
necessary to demonstrate the issue.
14. Third-party services and links
The services may interoperate with independent products and providers, including
Shopify, Apple, Microsoft, Supabase, Amazon Web Services, Shelly and other
supported-device manufacturers. Their own terms, availability and privacy
practices apply. Home Ecosystems is not responsible for an independent service,
but remains responsible for its own obligations under the contract and
applicable law.
15. Suspension and termination
You may stop using the services, delete an app account and cancel automatic
subscription renewal through the applicable billing provider.
We may restrict an account or cloud connection where reasonably necessary to
address a security risk, unlawful use, material breach, non-payment or harm to
other users or the service. Where appropriate, we will give notice and an
opportunity to remedy the issue.
Termination does not remove accrued payment obligations or provisions that by
their nature continue, including intellectual-property, legal-claim and
liability provisions. Supported local controller functions are not intended to
depend on an active cloud subscription.
16. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be
excluded or limited, including mandatory consumer remedies and, where
applicable, liability for death or personal injury, fraud, wilful misconduct,
gross negligence or mandatory product liability.
To the extent permitted by law, Home Ecosystems is not liable for losses caused
by operation contrary to published instructions, unsafe third-party equipment,
unauthorised electrical work, credentials disclosed by the user, or a
modification that caused the loss.
For customers acting in a trade or profession, and only to the extent permitted
by law, neither party is liable for indirect or consequential loss that was not
reasonably foreseeable when the contract was made. Any business-specific
liability allocation in an accepted written quotation takes precedence.
17. Events outside reasonable control
Neither party is responsible for delay caused by an event outside its reasonable
control, provided it takes reasonable steps to limit the impact and resumes
performance when possible. This does not remove consumer delivery, refund or
other remedies that mandatory law provides.
18. Governing law and disputes
These Terms are governed by Italian law.
If you are a consumer, this choice does not deprive you of mandatory protections
of the country where you habitually reside, and mandatory rules on jurisdiction
continue to apply. Consumers may contact support@home-ecosystems.com first so
we can try to resolve a complaint and may use any competent consumer
alternative-dispute-resolution body available under applicable law.
The former European Commission Online Dispute Resolution platform is not listed
because it was discontinued in 2025.
For a business-to-business dispute, the courts competent for the registered
office of Home Ecosystems SrL have exclusive jurisdiction unless a signed
agreement states otherwise.
19. Changes
The Terms in force when an order is accepted govern that order. We may update
website or ongoing-service terms for legal, security, technical or product
reasons. We will provide reasonable advance notice of a material change to an
ongoing paid service where required, together with any cancellation or remedy
required by law.
